Public Offer for the Purchase and Sale of Goods in the Online Store
1.1. This offer is an official proposal of Limited Liability Company "PROMYSLOVI ELEMENTY", EDRPOU code – 41042877 (hereinafter referred to as the "Seller"), to conclude a Contract for the purchase and sale of goods remotely, i.e., through the online store (hereinafter referred to as the "Contract") with any individual or legal entity that accepts the terms of this Offer (hereinafter referred to as the "Buyer").
1.2. The Seller publishes this Public Offer (proposal) on the official website: https://catprovocateur.com.ua/.
1.3. The full and unconditional acceptance by the Buyer of the Seller’s proposal (acceptance) to conclude an electronic contract for the purchase and sale of goods shall be deemed the fact of payment by the Buyer for the order under the conditions of this Contract, within the time frame and at the prices specified on the Seller’s website.
2.1. Public Offer (hereinafter referred to as the Offer) – a public proposal of the Seller addressed to an indefinite number of persons to conclude a contract for the purchase and sale of goods remotely under the terms specified in this Offer.
2.2. Goods or Service – the object of the agreement between the Parties, which has been selected by the Buyer on the Seller’s website and added to the shopping cart or already purchased by the Buyer remotely.
2.3. Online Store – the Seller’s website located at https://catprovocateur.com.ua/, designed for retail and wholesale purchase and sale agreements based on the Buyer’s familiarization with the description of the Goods provided by the Seller through the Internet.
2.4. Buyer – a legally capable individual who has reached the age of 18, or a legal entity or an individual entrepreneur, who has entered into a Contract with the Seller under the terms outlined below.
2.5. Seller – a company that sells the Goods presented on the Online Store website.
3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Contract.
3.2. This Contract governs the purchase and sale of goods in the Online Store, including:
- The voluntary selection of Goods by the Buyer in the Online Store;
- The independent placement of an order by the Buyer in the Online Store;
- Payment by the Buyer for the order placed in the Online Store;
- Processing and delivery of the order to the Buyer under the terms of this Contract.
4.1. The Buyer independently places an order in the Online Store through the "Shopping Cart" form or by placing an order via email or by phone specified in the "Contacts" section of the Online Store.
4.2. The Buyer has the right to place an order for any Goods presented on the Online Store website and available in stock.
4.3. Each item can be included in the order in any quantity.
4.4. The name, quantity, item number, and price of the Goods selected by the Buyer are indicated in the Buyer’s shopping cart on the Online Store website.
4.5. If a product is out of stock, the Seller’s manager is obliged to notify the Buyer (by phone or email).
4.6. The Seller has the right to refuse to transfer the order to the Buyer if the information provided by the Buyer at the time of ordering is incomplete or raises doubts about its validity.
5.1. The price of each item is indicated on the Online Store website.
5.2. The Seller has the right to unilaterally change the price of any Goods.
5.3. If the price of an ordered product changes, the Seller undertakes to inform the Buyer of the price change.
5.4. The Buyer has the right to confirm or cancel the order if the price changes after the order has been placed.
5.5. The Seller cannot change the price of a paid order.
5.6. The price of the Goods indicated on the Online Store website does not include delivery costs.
6.2. Upon receipt of the Goods, the Buyer must, in the presence of the delivery service representative, verify the quality and quantity of the Goods.
6.3. The Buyer confirms the receipt of the Goods by signing the invoice or delivery receipt.
7.2. The refund for the Goods is made within 30 calendar days from the date of receipt of the returned Goods by the Seller.
7.3. The cost of returning the Goods is borne by the Buyer, unless the return is due to a manufacturing defect or an error on the part of the Seller.
- Transfer the Goods to the Buyer in accordance with the terms of this Contract;
- Not disclose any private information about the Buyer and not grant access to this information to third parties, except as provided by law.
8.2. The Seller has the right to: - Change the terms of this Contract and the prices of Goods and services unilaterally by posting them on the Online Store website.
8.3. The Buyer undertakes to: - Familiarize themselves with the content of this Contract before making a purchase;
- Provide accurate personal data necessary for order processing and delivery.
9.1. The Seller is not responsible for damages caused to the Buyer due to improper installation, use, or storage of the purchased Goods.
9.2. The Seller and Buyer are responsible for fulfilling their obligations in accordance with the current legislation of Ukraine.
10.1. By providing their personal data on the Online Store website, the Buyer agrees to its processing under the Law of Ukraine "On the Protection of Personal Data".
10.2. The Seller undertakes not to disclose the information received from the Buyer, except as required by law.
11.2. Any disputes arising between the Buyer and the Seller shall be resolved through negotiations.
11.3. The Seller has the right to make changes to this Contract unilaterally.
